THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SMT. JUSTICE T. RAJANI WRIT PETITION No.27583 of 2017 ORDER: (Per VRS,J) The petitioner has come up with the above writ petition, challenging an order of penalty.

Heard Mr. G. Narendra Chetty, learned counsel for the petitioner. Mr. S. Suribabu, learned special standing counsel for the Commercial Tax Department, takes notice for the respondents. 3.

The impugned order of penalty was passed, as a consequence of the order of assessment, dated 31.05.2017. But, the order of assessment was set aside by this Court by an order, dated 11.07.2017, in W.P.No.21687 of 2017 and the matter remanded back. Therefore, the order of penalty shall also go as a consequence. 4.

Hence, the Writ Petition is allowed and the impugned order is set aside. However, it will be open to the respondents to take any consequential action, if a fresh order of assessment is passed.
