CRIMINAL PETITION NO. 215 OF 2018 O R D E R :

This Criminal Petition is filed by the petitioner under section 437 and 439 of Cr.P.C., seeking grant of bail to the petitioner, who is A-4 in Crime No. 702 of 2017 of Patmata Police Station, Vijayawada city, Krishna district, registered for the offences punishable under section 8 [c] read with section 20 [b] [ii] [c] of Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Heard the counsel for the petitioner and the learned Additional Public Prosecutor representing the respondent/State.

3. The counsel for the petitioner submits that the petitioner was found in possession of only 2 Kgs., of dry ganja, which is less than the commercial quantity. But the Additional Public Prosecutor opposed for grant of bail contending that this petitioner is instrumental for securing the entire ganja in possession of the other accused. It is only after securing the entire ganja, that this petitioner has been selling same ganja.

He also submits that the petitioner hails from Tamil Nadu State and if he is released on bail, there is every likelihood of his jumping bail.

4. Considering the above, this Criminal Petition is dismissed.

5. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
