HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.819 of 2019 ORDER:

The prayer of the petitioner is this case reads as under: "This Honourable Court may be pleased to issue a writ or order more particularly one in the nature of writ of Mandamus and declaring the action of the respondents in going ahead with the elections to the post of Surpanch consequent to the notification No.363/TSEC-PR/2018 dated 01.01.2019 issued by the 2nd respondent without any valid voters list and without considering the representations / application submitted though online in Mee Seva for inclusion of the name of the petitioner in the voters list of Devapur Village to enable her to cast her vote and participate in the Gram Panchayat Elections for the post of Surpanch to be held on 21.01.

2019 and considering in the cases of others as illegal, arbitrary, abuse of process of law and violative of Principles of Natural Justice and opposed to Articles-14, 19 and 21 of the Constitution of India and consequently direct the respondents to publish a valid voters list and conduct fair elections for the post of Surpanch of Devapur Village by declaring that the process of the conducting election without a valid voters list as bad under law and to pass such other order or orders as this Honourable Court may deem fit and proper in the interest of justice." Ms.

Priyanka Singh, learned counsel representing Sri P.Sudheer Rao, learned Standing Counsel for the Telangana State Election Commission, would inform this Court that the election to the post of Sarpanch of Devapur Gram Panchayat has already been held on 21.01.2019 and the result of the said election has also been declared.

In that view of the matter, the cause in this Writ Petition does not survive for consideration. The Writ Petition is accordingly dismissed on this short ground. This order shall however not preclude the petitioner from invoking appropriate remedies available to her in law if she is aggrieved by the conduct of the said election.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
