THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.802 OF 2020 ORDER:
The present Writ Petition is filed questioning the action of the 2nd respondent authority in not conducting investigation into the FIR No.179 of 2019 dated 27.08.2019, as being illegal and arbitrary.
Heard Sri Arun Kumar Doddla, learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions dated 21.01.2020, submits that basing on the complaint of the petitioner, a case was registered in Crime No.179 of 2020 under Sections 302, 498-A IPC read with Section 34 IPC and Section 4 of Dowry Prohibition Act, 1961 of Dharmaram police station on 27.08.2019. It is stated that during the course of investigation, the 2nd respondent authority visited the scene of offence, prepared panchanama, L.Ws-1 to 19 were examined and their statements were recorded, obtained PME and FSL reports, and arrested accused Nos.1 to 5 on 03.01.2020.
It is further submitted that the investigation in the case is completed, case is being charged, and charge sheet would be filed within two weeks. Having regard to the fact, that the investigation in the matter is completed and the 2nd respondent authority has sought for two weeks time to file the charge sheet in the matter, it cannot be stated that the authorities are not conducting investigation.
Recording the said submission made by the learned Assistant Government Pleader for Home, no further orders need be passed in the matter.
Accordingly, the Writ Petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
