HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims that he owns land to an extent of Ac.15.00 in Sy.No.13(A)(1)(A) of Mylarampally village, Uravakonda Mandal, Ananthapuram district. Petitioner was granted pattadar pass books and has been in peaceful possession and enjoyment of the said land. Petitioner intended to dispose of the property. He came to know that his property is included in the prohibited list of properties under Section 22 (A)(1)(a)&(b) of the Registration Act, 1908. In compliance with the directions issued by the Full Bench of this Court in W.A.No.343 of 2015 and batch, dated 23.12.2015, petitioner submitted representation to the District Collector, Ananthapur District, on 18.06.2017 requesting to exclude the subject property from the list of prohibited properties. Alleging inaction on the said request, this writ petition is filed. 2.
Since representation was already made and the same is pending consideration, this Court is not inclined to admit and keep the writ petition pending.
3.
Writ petition is disposed of, directing the District Collector to examine the claim of the petitioner as ventilated in the representation dated 18.06.2017 and pass appropriate orders as warranted by law, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. It is needless to observe that in case District Collector is accepting the stand of the petitioner, consequential notification should be
issued informing the registering authority deletion of the subject property from the list of prohibited properties. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO Date: 22.09.2017 kkm
