Respondent HON'BLE SRI JUSTICE G.CHANDRAIAH AND HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Appeal No. 759 of 2013 JUDGMENT: (Per Hon'ble Sri Justice G.Chandraiah) This appeal is filed by the appellant/sole accused, aggrieved by the conviction and sentence awarded by the Special Sessions Judge for SCs & STs CasesCum-Additional Sessions Judge, Anantapuram, in S.C.No.225 of 2013 dated 28.06.2013, by and under which the appellant/accused was sentenced to death, subject to the confirmation of the same by this Court for the offence punishable under Sec.302 IPC. The appellant was also convicted and sentenced to undergo rigorous imprisonment for a period of ten years for the offence under

Sec.307 IPC.

2. While so, the learned trial Judge referred the matter to this Court under Sec.363 Cr.P.C., through his letter dt. 05.07.2013, vide the Referred Trial No.2 of 2013, for confirmation of death sentence awarded to the accused. The said matter came up for hearing before us on 22.09.2014 and was closed as abated, on the ground that the sole accused expired on 24.08.2014 at about 9.00 a.m. in Osmania General Hospital, Hyderabad, while undergoing treatment, due to cardiac arrest.

3. In that view of the matter, the present appeal is dismissed as having been abated. The material objects, if any, shall be destroyed. _________________ G. CHANDRAIAH, J.
