Kothapalli Hari Krishna v. The State Of Andhra Pradesh
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.2 1 2 of 2 0 1 8 ORDER:
This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, seeking grant of bail to the petitioner, who is A5, in Cr.No.35 of 2017 on the file of the Station House Officer, Rajanagaram Police Station, Rajamahendravaram District.
The offences alleged are under Sections 8(c) read with 20(b)(ii) of NDPS Act.
2.
Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.
3.
The Public Prosecutor brings to the notice of this Court that earlier bail petitions, filed by the petitioner, were dismissed by virtue of the orders in CRLP.Nos.11514 and 12403 of 2017 dated 21.12.2107;
CRLP.No.7331 of dated 31.08.2017 and CRLP.No.2901 of 2017 dated 13.04.2017.
4.
A perusal of the said orders shows that the merits of the case were considered while the bail petitions were dismissed. 5.
The contention of the counsel for the petitioner that the changed circumstance is that charge sheet is filed is also refuted by the Public Prosecutor by contending that this petition is a third petition after filing of the charge sheet.
6.
Hence, considering the above, this Court does not find it a fit case for grant of anticipatory bail to the petitioner.
The criminal petition is dismissed as not maintainable.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
