THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18396 of 2008 ORDER:
In this Writ Petition, the main grievance of the petitioner, as espoused in the writ affidavit, is that the objections filed by her pursuant to enquiry under Section 5-A of the Land Acquisition Act, 1894, were ought to have been considered by the first respondent - District Collector, East Godavari, Kakinada, instead of rejecting them, vide proceedings, dated 13.07.2008. This Court vide its orders, dated 25.08.2008 granted stay of dispossession of the petitioner with respect to the land of an extent of Ac.0.98 cents in Survey No.420/1A of Vemulawada Village, Karapa Mandal, East Godavari District. When the matter is taken up for hearing, learned Government Pleader for Land Acquisition appearing for the respondents had produced before this Court a copy of the written instructions received from the second respondent - Revenue Divisional Officer & Land Acquisition Officer, Kakinada, vide letter, dated 01.05.2010, and submits that the land to an extent of 0.98 cents in Survey No.420/1A was not required and thus, vide letter, dated 01.10.2008, an errata to the draft notification under
CKR, J WP.No.18396 of 2008 Section 4(1) of the Act was submitted by the second respondent to the first respondent for approval and thus, the draft notification issued under Section 4(1) of the Act ceased to have valid by April, 2009. In other words, as the subject land is not required, there is no necessity of land acquisition proceedings. In view of the above, this Writ Petition is closed. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
