HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.8052 of 2013 ORDER:

Heard Mr. Gade Venkateswara Rao, for petitioner and the learned Assistant Government Pleader (Home) for respondent.

2. The petitioner, being dissatisfied with the investigation in Cr.No.266 of 2012 of Punganur PS, Punganur Town & Mandal, for the offences punishable under Sections 454 and 380 of IPC, has filed the instant writ petition.

3. The sole respondent has filed counter-affidavit and has stated the steps taken to investigate the crime, apprehension of the accused and also recovery of stolen property. The complaint of the respondent as against the petitioner is that the petitioner is not cooperating with the investigation.

4. Mr. Gade Venkateswara Rao, counsel for the petitioner submits that the said statement is false and incorrect and his client is always prepared and cooperative in the investigation. The Assistant Government Pleader submits that if a final report is not filed as on date, the respondent will issue return notice to the petitioner for appearance before the respondent for further investigation. If such a notice is issued, it is needless to observe that the petitioner is under obligation to cooperate and the petitioner if chooses not to cooperate, the respondent is free to finalise the final report and file the same before the concerned court. The said exercise shall be completed within three months from the date of receipt of a copy of this order.

5. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
