THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5002 of 2012 ORDER:

The grievance of the petitioner was as to the alleged inaction on the part of the police authorities upon her complaint dated 15.02.2012.

The Sub-Inspector of Police, Raidurgam Police Station, Cyberabad Commissionerate, furnished written instructions dated 10.08.2015 to the Office of the learned Government Pleader for Home stating that the petitioner had filed a private complaint before the learned VIII Metropolitan Magistrate, Cyberabad, against respondents 3 and 4 and upon the said complaint being forwarded, the Station House Officer, Raidurgam Police Station, Cyberabad, registered Crime No.172 of 2012 on the file of the said Police Station under Sections 307, 352, 355, 427, 447, 448 and 506 I.P.C. However, upon due investigation, the police authorities found no cognizable offence was made out for further action and accordingly filed a final report under Section 173 Cr.P.C, before the learned VIII Metropolitan Magistrate, Cyberabad, on 31.10.2012 vide Inward No.

9557 of 2012 referring the case as 'Mistake of Fact'. Notice of the same was stated to have been issued to the petitioner by speed post on 30.10.2012. In the light of the aforestated developments, it is clear that the allegation of the petitioner as to inaction on her complaint was without basis. In the event the petitioner is aggrieved by the final conclusion arrived at by the police authorities upon investigation of the case, it is for her to take recourse to appropriate measures in accordance with law.

Reserving liberty to the petitioner to do so, the writ petition is closed.

Pending Miscellaneous Petitions, if any, shall also stand closed. No order as to costs.
