Heard learned counsel for the petitioner, learned Government pleader for Minority Welfare for respondent No.1 and Sri Mirza Safiullah Baig, learned Standing counsel for Wakf Board for respondent No.2.

Petitioner was awarded contract for collection of Vowed Hairs, Live Goats and statue of Hoarse at Dargah Hazrath Syed Sadullah Hussaini on nomination basis for an amount of Rs.10,00,000/- vide proceedings dated 18.09.2017. The said allotment was challenged before this Court in W.P.No.37053 of 2017. This Court suspended the proceedings dated 18.09.2017. In view of the interim order, the charge was handed over to the Inspector Auditor Wakf on 04.04.2018. According to petitioner, in terms thereof assigned work was undertaken for a period of 191 days and the amount calculated as per contract, for the said period, would come to Rs.3,66,312/-. Petitioner therefore, claims that he is entitled to refund of balance amount. Alleging inaction in refunding the balance amount, this writ petition is filed.

On instructions, learned Standing counsel submits that refund of the amount is not in dispute and the issue is under process and if reasonable time is granted the amount would be released.

Recording the said statement, the Writ Petition is disposed of directing the Wakf Board to release the balance amount to the petitioner as expeditiously as possible preferably within a period of three (3) weeks from the date of receipt of copy of this order.
