This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri P. Animi Reddy, Advocate for the Petitioner and the Public Prosecutor (TG) on behalf of the Respondent.

ORDER

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/Al, seeking to grant bail to him in connection with Crime No.1240 of 2020 on the file of tvliyapur Police Station, Cyberabad Commissionerate, Ranga Reddy District, registered for the offences punishable under Sections 304-8, 498-4, 323 IPC and under Sections 3 and 4 of Dowry Prohibition Act.

Heard learned counsel for the petitioner/A1 , learned Assistant Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner/Al submits that the petitioner is no way concerned as to the death of the deceased Bandi Naga Sai l\,4ani Deepika as he never demanded the deceased for additional dowry or for disposal of her property and he never harassed the deceased at any point of time. He further submits that the deceased has committed suicide by hanging herself without any sufficient reason. He further submits that the police examined all the material witnesses including de-facto complainant and the entire t investigation is completed except filing of the charge sheet. He also submits that the petitioner is a law abiding citizen and he shall cooperate with the investigation and he shall abide by any condition imposed by this Court.

Learned Assistant Public Prosecutor vehemently opposed to I I grant bail to the petitioner/A1 and submits that there are specific

allegations against the petitioner/A'l that he used to harass the deceased mentally and physically for additional dowry. 5.

As seen from the contents of the remand report, it reveals that on the date of alleged occurrence i.e., on 29.11.2020, the de-facto complainant has received a phone call from his granddaughter that her father was assaulting her mother every day and later, the deceased was also informed him that her husband i.e., 41, was beating her every day and that when the de-facto complainant asked, A1 abused him in filthy language and disconnected the call. Even as per the post-mortem report, the deceased died under unnatural circumstances within seven years of her marriage and there are specific allegations against the petitioner about the cruelty inflicted upon the deceased soon before her death. Thus, looking into the nature of allegations leveled against the petitioner/Al , I am not inclined to grant bail to him and his prayer for bail is rejected.

Accordingly, the Criminal Petition is dismissed. 7.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
