HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.32491 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and the learned Government Pleader for Women Development and Child Welfare appearing for the respondents. This writ petition is filed questioning the Notification dated 01-10-2015 of the 5th respondent-Child Development Project Officer and to declare that the action of the respondents in fixing the maximum age limit to the post of Anganwadi Worker as 35 years without any relaxation of age for the in-service candidate and not considering the candidature of the petitioner for the interview as without justification and bad in law and also violative of the provisions of Articles 14 and 16 of the Constitution of India.

It is submitted by the learned counsel appearing for the petitioner that the petitioner has been working as a part-time drawing teacher. However, the notification dated 01-10-2015 prescribes the maximum age limit as 35 years. It is further submitted that since the petitioner has been working as a part-time drawing teacher, her candidature can be considered along with other candidates pursuant to the Notification dated 01-10-2015.

Since the petitioner is discharging the duties of part-time drawing teacher, the respondents are directed to consider her application in relaxation of the prescribed age limit in the impugned Notification along with other candidates. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
