THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.360 of 2016 ORDER:

This application is filed to withdraw F.C.O.P.No.50 of 2013 from the Court of V Additional District Judge - cum - Family Court, Visakhapatnam, and transfer the same to Family Court, Vijayawada.

2. Advocate for petitioner represented that when the husband insisted for commencement of trial, chief affidavit is filed in the year 2014 and thereafter, no steps are taken to proceed with case and for that reason, husband is compelled to file this application for transfer of F.C.O.P.No.50 of 2013 from the Family Court, Visakhapatnam to the Family Court, Vijayawada.

3. As the main grievance of petitioner is that the Family Court, Visakhapatnam has not taken up the case, I feel instead of transferring the case, this transfer petition can be disposed of by directing the Family Court, Visakhapatnam to decide the case with time schedule.

4. For these reasons, this Transfer C.M.P. is disposed of directing the Family Court, Visakhapatnam to dispose of F.C.O.P.No.50 of 2013 as expeditiously as possible, preferably within three (03) months from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed. ___________________ S. RAVI KUMAR, J 10th August, 2016.
