THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.25575 OF 2017 ORDER:

This Writ Petition is filed challenging the award of tender by respondents 2 and 3 in favour of the fourth respondent which is stated to have been disqualified due to non-possessing of license as per Section 5 of PSARA Act, 2005.

Though this Court granted an order of status quo by order dated 01.08.2017, the fourth respondent has been operating the contract as on today. The contract has also come to an end. Since the award of contract is for a period of one year during the year 2017-18, no useful purpose would be served by examining the award of contract in favour of the fourth respondent at this length of time. In the circumstances, it is open to the petitioner to submit a representation to respondents 2 and 3 not to entertain the bids of persons who do not possess an appropriate license under the provisions of the PSARA Act, 2005 hereinafter. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
