Sumanth, learned counsel for the respondent, would fairly state that the order of the learned Single Judge, to the extent it relates to imposition of costs of Rs.5,000/-, may be set aside, but the cause in the writ appeal does not survive. Learned Government Pleader for Roads and Buildings appearing for the appellants, fairly states that the cause, in view of passage of time, no longer survives.
The order of the learned Single Judge, to the extent costs were imposed, is set aside. The writ appeal is, however, dismissed as infructuous. Miscellaneous petitions pending, if any, shall also stand dismissed.
