Heard counsel for the petitioner and the Government Pleader for Revenue appearing for the respondents.
2. Petitioner's grievance is that he is the owner of the subject property having purchased the same under a registered sale deed No.6384/2008 dt.15.12.2008; that he along with his vendor through his GPA approached the 3rd respondent with a draft rectification deed; but the 3rd respondent is not receiving the said document for the purpose of registration.
3. The Government Pleader for Revenue appearing for respondents states that the 3rd respondent would receive the rectification deed presented by the petitioner and if he does not wish to register it, he will pass orders under Section 71 of the Registration Act, 1908 (for short 'the Act') giving reasons why he does not wish to register the said document.
4. In view of the said submission, the Writ Petition is disposed of directing the 3rd respondent to receive the rectification deed presented by the petitioner, and if the 3rd respondent does not wish to register it, he shall pass an order, why he does not wish to register, under Section 71 of the Act within a period of eight (08) weeks from the date of presentation of documents by the petitioner and communicate his decision thereon to the petitioner. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
