HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 29119 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner is a Fair Price Shop Dealer to Shop No. 7 o f Suddapalli Village, Pedamudiam Mandal, YSR District. The authorization of the petitioner was suspended by the second respondent through proceedings dated 22.8.2014 and questioning the same, the petitioner filed Writ Petition No. 25773 of 2014. This Court disposed of the said Writ Petition by order dated 03.09.2014 directing the second respondent to conduct an enquiry and pass final order while setting aside the suspension of authorization. Thereafter, though the petitioner submitted her explanation, the second respondent suspended the authorization of the petitioner through proceedings dated 10.03.2014.

Challenging the same, the petitioner preferred an appeal to the first respondent and the said appeal was dismissed on 04.08.2015. Against the said order, the present Writ Petition is filed.

As many as four charges are levelled against the petitioner and the first and second respondents considered the case of the petitioner at primary and appellate stages respectively. Against the dismissal of the appeal preferred by the petitioner, alternative remedy of statutory revision is available and in that view of the matter, this Court is not inclined to go into the merits or otherwise of the charges levelled against the petitioner and findings recorded thereon. In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to prefer a revision to the competent authority against the order dated 04.08.2015 passed by the first respondent within a period of fifteen days from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
