This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A2, in Crime No.199 of 2017 on the file of Chillakur Police Station, SPSR Nellore District. The offences alleged are under Sections 376, 417, 493, 312 r/ w 34 IPC. 2.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The allegation against this petitioner is that after the de facto complainant became pregnant due to the relationship between herself and A1, A1 along with A2 and A3 made the de facto complainant consume some tablets, for aborting the pregnancy, saying that A1 would marry her and later, A1 did not keep his promise.

Prima facie, the ingredients of Section 417 IPC get attracted to the facts of the case, even for A2. Hence, this court finds no merit in the contention of the petitioner's counsel that except Section 312 IPC, which is a bailable offence, no other offences are attracted.

In the above circumstances, this court opines that this is not a fit case for granting anticipatory bail.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
