CRIMINAL PETITION NO. 243 OF 2018 O R D E R :

This Criminal Petition is filed by the petitioner under section 438 of Cr.P.C., seeking grant of anticipatory bail to the petitioner, who is A-7 in Crime No. 95 of 2016 of Rompicharla Police Station, Guntur district, registered for the offences punishable under section 302 of I.P,C.

2. Heard the counsel for the petitioner and the learned Additional Public Prosecutor representing the respondent/State.

3. The Additional Public Prosecutor submits that the earlier anticipatory bail petition filed by this petitioner was dismissed by this Court considering the merits of the case and by observing that there is specific overt act against this petitioner and that he also instigated one Veera Reddy, who hacked the deceased, which resulted in his death later. The said order is passed in Crl.P.No. 1313 of 2017, dated 22/02/2017.

4. Hence, in view of the fact that the anticipatory bail petition filed by the petitioner was dismissed on merits and the submission made by the counsel for the petitioner that the petitioner was in hospital since 2016 was very much available even at the time of the order passed by this Court refusing to grant anticipatory bail in Crl.Petition No. 1313 of 2017, dated 22/02/2017. This court opines that this criminal petition is not maintainable.

5. In the result, this Criminal Petition is dismissed.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
