THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12586 OF 2016 ORDER:
This writ petition is filed challenging the action of the respondents, particularly the fourth respondent in taking the signature of the petitioner on while blank paper in his unconscious and depressed mood and drafting a complaint on his own to save the culprits involved in real incident. The learned Government Pleader, on the basis of the written instructions, submits that the allegations mentioned in the affidavit are false. Basing on the complaint of the petitioner, dated 07.03.2016, in respect of the accident dated 06.03.2016, crime No.17 of 2016 was registered on 07.03.2016 and investigation was completed. A final report was also filed on 06.11.2016.
In view of the same, it is open to the petitioner to take appropriate action in accordance with law in respect of the final report filed before the Court of Judicial First Class Magistrate, Naidupet, on 06.11.2016.
