The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri J P SRIKANTH, Advocate for the Petitioner, PUBLIC PROSECUTOR for the Respondent, the Court made the following.

THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.197 OF 2O2L ORDER:

This is an application for regular bail. The petitioner herein is accused No.1 in Crime No.424 of 2O2O of Bhadrachalam Town Poiice Station, Bhadradri-Kothagudem District. The offences alleged against the petitioner are under Section 8(c) read with Section 20 (b) of the Narcotic Drugs and Psychotropic Substances Act.

Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the record.

According to the prosecution, the petitioner was transporting ganza weighing 105 kgs., and his vehicle i.e., Toofan bearing registration No.AP-24-TA-7869 was seized from his possession under a cover of panchanama. Learned Public Prosecutor, on instructions, would submit that the Investigating Officer has recorded the statements of eight witnesses under Section 161 of Cr.P.C., and FSL report is awaited.

4. A perusal of the material would reveal that the t t petitioner is in jail from 14.12.2O2O. As stated supra, the Inve stigating Officer has already recorded the statements of eight witnesses and FSL report is pending. The petitioner is a driver. According to the learned Public Prosecutor, there are no cases against the petitioner for the similar offences

Considering the said aspects, this Court is inclined to grant regular bail to the petitioner.

Accordingly, the Criminal Petition is allowed and the petitioner is granted bail subject to the following conditions: i. The petitioner sha1l execute a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties lor the like sum each to the satisfaction of the Special Sessions Judge for Trial of Cases under NDPS Act-cum-l Additional Sessions Judge at Khammam.

ii. The petitioner sha11 appear before the Station House Officer, Bhadrachalam Tou,n Police Station, Bhadradri-Kothagudem District, on every Sunday between 10.00 AM and 5.00 PM, till completion of investigation and filing of charge sheet.

iii. The petitioner shall cooperate with the Investigating Officer.

Miscellaneous petitions pending, if any, sha1l stand disposed of.
