Bismillah Khan v. The State Of Telangana, Rep By Its Principle Secretary,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.10789 OF 2016 O R D E R :
Heard counsel for the petitioners and the Government Pleader for Revenue appearing for the respondents.
2.
Petitioners' grievance is that while they stay in the upstairs portion of H.No.10-6-203/5/6 situated in Baada Bazaar, First Lancer, Hyderabad, respondents 5 to 7, who are their children, stay in the downstairs portion of the same premises and they are harassing the petitioners to grab the said property.
3. It is stated by the counsel for the petitioners that petitioners have filed an application before the 2nd respondent under the Maintenance and Welfare of Parents and Senior citizens Act, 2007 to evict the respondents 5 to 7, but the 2nd respondent is not conferred with any jurisdiction under the said Act to grant such a relief to the petitioners and that the petitioners actually want their possession to be protected. 4.
In view of these submissions, petitioners are directed to file appropriate petition before the 2nd respondent for protection of their possession in premises bearing H.No.10-6-203/5/6 situated at Baada Bazaar, First Lancer, Hyderabad; and if such an application is filed, the 2nd respondent shall deal with it, with utmost expedition, within a period of two (02) weeks from the date of filing of the said application.
5. The Writ petition is accordingly disposed of. There shall be no order as to costs.
6. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
