JUDGMENT

When the matter is taken up for hearing, there is no representation for the appellant.

On 30.11.2022, appellant's counsel seeks time to verify whether cause of action survives or not. But, he has not turned up. On 29.08.2008, it is recorded that possession was delivered through Court and the same was recorded by the Court. The respondent herein filed O.S. No.9 of 1999 seeking declaration and recovery of possession and it was decreed. Aggrieved thereby, the present appeal is filed by the defendant.

Since, there is no representation for the appellant, this Court is of the considered view that no purpose would be served in continuing the appeal.

Accordingly, Appeal is dismissed for non-prosecution. No costs.

Pending miscellaneous applications, if any, shall stand closed.
