THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.1126 OF 2006 JUDGMENT:

This Second Appeal is filed under Section 100 of C.P.C. by the defendant assailing the decree and judgment dated 11.03.2004 in A.S.No.210 of 2001 on the file of the Court of the VII Additional District Judge (Fast Track Court), Visakhapatnam, wherein and whereby the decree and judgment dated 24.08.2001 in O.S.No.67 of 1996 on the file of the Rent Controller-cum-IV Additional Junior Civil Judge at Visakhapatnam, decreeing the suit for specific performance was set aside, and directed the defendant to refund the money.

During pendency of the appeal, the matter was referred to Lok Adalat. Both parties entered into a compromise before the Lok Adalat at Visakhapatnam. The Lok Adalat Bench passed an award in terms of the compromise.

Hence, the Second Appeal is disposed of in terms of the Award passed by the Lok Adalat on 29.12.2016. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
