HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44724 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 4th respondent in conducting enquiry for mutation of petitioner's name in revenue records and disposing of the Form VI-A application filed by the petitioner, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.

The limited grievance of the petitioner in this writ petition is that though he filed Form-VIA application before the 4th respondent seeking mutation of his name in revenue records and issuance of pattadar pass books and title deed in respect of lands admeasuring Ac.1-19 cents in survey No.88/1, Ac.1-00 cents in survey No.88/2 and Ac.1-00 cents in survey No.88/3 situated at Jame Nave Pothavaram Village, Ibrahimpatnam Mandal, Krishna District, on 06.09.2016, till date no orders are passed. Said inaction on the part of the 4th respondent is the subject matter of challenge in this writ petition.

Learned AGP would submit that a suitable direction may be given to the 4th respondent for disposal of application submitted by the petitioner on 06.09.2016, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent-Tahasildar to dispose of the Form-VIA application submitted by the petitioner seeking mutation of his name in revenue records and issuance of pattadar pass books and title deed in respect of lands admeasuring Ac.1-19 cents in survey No.88/1, Ac.1-00 cents in survey No.88/2 and Ac.1-00 cents in survey No.88/3 situated at Jame Nave Pothavaram Village, Ibrahimpatnam Mandal, Krishna District, on 06.09.2016 after hearing the petitioner and other aggrieved persons, if any, in accordance with law, as early as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.
