THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.455 OF 2017 JUDGMENT:

This Second Appeal is filed, by the defendant, under Section 100 of C.P.C., assailing the judgment and decree dated 20.04.2017 passed in A.S.No.325 of 2015 on the file of the Court of II Additional District Judge, Vijayawada.

Learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal and a letter was also filed in the Registry to that effect. Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
