HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7568 OF 2015 ORDER:

Challenging the action of the 4th respondent in not allowing the petitioners to enjoy the land which is adjacent to the land of the petitioners' families, the present writ petition is filed. It is the case of the petitioners that they are in possession and enjoyment of the property over an extent of Ac.1.40 cents and Ac.0.75 cents in Sy.No.90/1 respectively of Sankar Royalpet Village, Peddapanjani Mandal, Chittoor District, which are adjacent to the lands owned and possessed by the petitioners' families and the petitioners are entitled for consideration of granting of pattas, as per the scheme of the B.S.O 15 of the A.P. Board Standing Orders and the Revised Assignment Policy. It is stated that the petitioners submitted representations dated 15.12.2014 and 09.12.

2014 to the respondents 2 to 4 bringing to their notice about the possession and enjoyment of the above said land, but there are no orders as such were passed on the representations of the petitioners so far. Petitioners alleged that the 4th respondent had directed them to vacate the land and threatened that the same will be allotted to third parties. Hence, the present writ petition.

Heard Smt S. Parineeta, learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. As can be seen from the material placed before this Court such as electricity bills and the payment receipts, it can safely be said that atleast from 2010, the petitioners have been in possession and enjoyment of the property and even on earlier occasions, the petitioners had submitted representations on 15.12.2014, 18.02.2014 and 20.02.2015.

Petitioners claimed that they have been in possession and enjoyment of the land being adjacent to their patta land and they claimed to have developed the same. In that view of the matter, without expressing any opinion, the

writ petition is being disposed of with a direction to the respondents 2 to 4 to consider the representations of the petitioners dated 15.12.2014 and 09.12.2014 for grant of pattas in their favour within a period of four months from today in terms of the scheme and policies in vogue. As the petitioners claim that there is standing crop in the land in question, till such time, the authorities dispose of the representations dated 15.12.2014 and 09.12.2014, the petitioners shall not be forcibly evicted.

With the above direction, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed.
