Notice sent returned as not in village and unclaimed is a sufficient service to the respondent.

The respondent's petition for divorce against petitioner herein (his wife) in O.P.No.180 of 2014, pending on the file of the Senior Civil Judge, Tanuku of west Godavari District. In the cause title of the petition, he shows his residence at Vanne Chintalapudi Village of Amalapuram Mandal, East Godavari District and the address of his wife shown as Plamuru Sivaru, Polamuru, Penumantra Mandal, West Godavari District, within the jurisdiction of Senior Civil Judge Court at Tanuku.

The marriage was stated performed at Amalapuram on 11.03.1993. Now, in the affidavit filed by the wife as respondent in that divorce O.P. in seeking to transfer from Senior Civil Judge, Tanuku to Senior Civil Judge at Amalapuram, she claims in the affidavit that she is also residing at Cheyyeru Agraharam Village of Katrenikona Mandal of Mummidivram, Amalapuram, within the jurisdiction of Senior Civil Judge Court, Amalapuram. 3.

Accordingly and from the above, the transfer civil miscellaneous petition is allowed and OP No.180 of 2014

pending on the file of Senior Civil Judge, Tanuku, West Godavari District, is withdrawn and transferred to the Senior Civil Judge, Amalapuram, East Godavari District, for restoration and early disposal.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
