ORDER
This writ petition is filed seeking the following relief: "...To issue a Writ Order or direction more in the nature of Mandamus declaring the action of the Respondent-Public Service Commission in including Hall Ticket No. 1753020904 and 1753014855 in the provisional select list of Secondary Grade Teachers English Medium for the scheduled areas of Warangal District, without including the said Hall Tickets in the list of verification of S.
T certificates is illegal, arbitrary and in violation of Articles 14, 16 and 21 of the Constitution of India and consequently declare that the Respondents cannot include the two Hall Tickets in the list of selected candidates with a direction to consider the case of the petitioner for her appointment as per her merit and to pass such other order or orders as this Hon'ble High Court may deem fit and proper in the circumstances of the case." Heard Sri P.V.Ramana, learned counsel appearing for the petitioner, Sri D.Bala Kishan Rao, learned Standing Counsel appearing for respondent No.1 and learned Government Pleader for School Education appearing for respondents 2 to 6.
It is the case of the petitioner that the 1st respondent issued notification dated 21.10.2017 for recruitment of Secondary Grade Teacher (English Medium) in Warangal District, reserved for local scheduled tribe candidates. Since the petitioner is a local scheduled tribe candidate, he applied for the said post and participated in the written test. Though he secured 38.868 marks, his case was not short-listed.
The grievance of the petitioner is that some ineligible candidates have been included in the selected list and some of the candidates do not belong to local schedule tribe community. Hence, he submitted a representation to the respondents requesting them to verify the certificates in respect of the selected candidates. Pursuant thereto, the respondents have sent the list of selected candidates for verification to the authorities to ascertain as to whether the selected candidates belong to local scheduled tribe or not. Further, in respect of Hall Ticket Nos.1753015983 and 1753014855, certificates were not sent for verification. As this factum was not brought to the notice of the respondents, the petitioner has submitted a representation to them on 3.1.2019, but, so far no orders have been passed thereon.
Learned counsel appearing for the petitioner submits that appropriate orders be passed directing the respondents to verify the genuineness of local scheduled tribe certificates issued in favour of Hall Ticket Nos.1753015983 and 1753014855 and if the certificates are found not genuine, then the case of the petitioner be considered for appointment to the post of Secondary Grade Teacher.
Learned Standing Counsel appearing for the 1st respondent submits that certificates of all the candidates will
be verified in accordance with law and appropriate orders will be passed on the representation submitted by the petitioner. Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that ends of justice would be met if a direction is given to the respondents to consider the representation submitted by the petitioner on 3.1.2019.
Accordingly, the Writ Petition is disposed of directing the respondents to consider the representation of the petitioner dated 3.1.2019 and pass appropriate orders thereon in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending shall stand closed.
