THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.6952 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners/accused Nos.2 and 3 in C.C.No.53 of 2015 on the file of I Additional Chief Metropolitan Magistrate Court at Nampally, Hyderabad.
2 At the time of arguments, the learned counsel for the petitioners seeks permission of the Court to permit the petitioners to withdraw the petition with a liberty to avail the remedies available to them under law, including filing of a petition for discharge before the trial Court if charges are not already framed. The learned counsel for the petitioners further requested this Court that the presence of the petitioners may be dispensed with before the trial Court for each and every adjournment. Permission accorded. 3 There is no dispute with regard to the identity of the petitioner No.2/Accused No.3. Even if the presence of the petitioner No.2/Accused No.3 is dispensed with, no prejudice will be caused to the 2nd respondent. 4 In the result, the Criminal petition is dismissed, granting the liberty as prayed for.
The presence of the petitioner No.2 / Accused No.3 in C.C.No.53 of 2015 on the file of I Additional Chief Metropolitan Magistrate Court at Nampally, Hyderabad, who is aged about 55 years, is hereby dispensed with for each and every adjournment. However, the petitioner No.2 / Accused No.3 shall appear before the said Court as and when her presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
