THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.15278 OF 2013 ORDER:

There is no representation on behalf of the petitioner. Heard the learned Government Pleader appearing for the respondents. The prayer sought for in the writ petition is as under: " to issue a writ order or direction more particularly a writ of Mandamus declaring the actions of 3rd respondent in interfering with the peaceful possession and enjoyment of agricultural property of the petitioner in Sy. Nos. 509/ 2 and 509/ 3 admeasuring Ac. 2.00 guntas, situated at Aliabad Village, Shameerpet Mandal, Ranga Reddy District as arbitrary, discriminatory, illegal, ultra vires, null and void, in violation of principles of natural justice and against the fundamental constitutional rights of the petitioner in the interest of justice and equity." The respondent No.3 filed a counter affidavit stating that the petitioner lodged a complaint dated 09.05.

2013 with the 3rd respondent stating that he is the owner of land admeasuring Ac.2.00 gts. In Sy.No.509/ 2 and 3, situated at Aliabad Village, Shameerpet Mandal, Ranga Reddy District, but however, one D.K.Giri tried to grab his land by threatening. Pursuant to the said complaint, Crime No.112 of 2013 was registered for the offences under Sections 447 and 506 I.P.C. When the said investigation was in progress, the said D.K.Giri lodged a complaint against the petitioner on 14.05.2013 stating that he is the owner of the land to an extent of Ac.5.00 gts. in Sy.No.509, situated at Aliabad Village, Shameerpet Mandal, Ranga Reddy District. But the petitioner and others trespassed and damaged the property and further threatened him. Basing on the said complaint, Crime No.114 of 2013 for the offences under Sections 447, 427, 351 and 506 I.P.C.

been registered and the matter is under investigation. Except the registration of crimes and investigation thereto, the respondentspolice never interfered in the civil disputes between the petitioner and the said D.K.Giri.

Taking the said submission into consideration, this Court is of the opinion that no further orders are required in the writ petition and the same is accordingly dismissed. No costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.KESHAVA RAO,J 03rd DECEMBER 2018.
