THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.904 OF 2016 ORDER:

This Criminal Petition is filed by the accused under Section 482 of Cr.P.C. seeking to quash the orders dated 26.11.2015 passed by IV Additional Junior Civil Judge-cumJudicial Magistrate of First Class, Guntur, whereby the learned Magistrate dismissed Crl.M.P.No.4537A of 2015 in C.C.No.74 of 2007 filed under Section 70(2) Cr.P.C. to recall the NBWs issued against the petitioner.

Heard the learned counsel for the petitioner and learned Additional Public Prosecutor. Perused the records. In the circumstances of the case, the petitioner is directed to surrender before the Court below and file an application seeking to recall the warrant along with an affidavit giving an undertaking that he would appear before the Court below on every hearing date. On filing such application and affidavit, the Court below is directed to recall the Warrant issued against the petitioner on the same day on execution of a bond by the petitioner for a sum of Rs.10,000/- with one surety. Further the petitioner shall appear before the Court below daily for one week and thereafter on all hearing dates.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
