This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner, to modify the conditional bail order dated 09.03.2018 in Crl.M.P.No.191 of 2018 in Crime No.74 of 2016 on the file of the IX Additional District and Sessions Judge, Siricilla and to direct the authority concerned to return the passport to the petitioner, who is an Austria citizen. 2.

Heard the learned counsel for the petitioner, the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

It is contended that there is a dispute in between the petitioner and his brother, and the petitioner has filed a suit for partition and is ready to abide by the conditions, if any, imposed by this Court. The condition of deposit of passport was imposed by the Court of IX Additional District and Sessions Judge, Siricilla on 09.03.2018 in Crl.M.P.No.191 of 2018 in Crime No.74 of 2016. The petitioner has not moved any application before the said Court which imposed the said condition. There are no sufficient circumstances to consider the request made on behalf of the petitioner by this Court under Section 482 Cr.P.C. Under these circumstances, the petitioner is granted liberty to file a similar application before the Sessions Court concerned. 4.

With the above observation, the Criminal Petition is disposed of.

Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
