ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who arrayed as accused Nos.3 and 4 in Crime No.11 of 2026 before the RGI Airport Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 85 and 108 of BNS.

The brief facts of the case are that, on 03.01.2026, the de-facto complainant, who is the father of the deceased, lodged a report before the police stating that he performed the marriage of his daughter (deceased) with accused No.1 in the year 2017. It is alleged that accused Nos.1 and 2 used to harass the deceased for additional dowry and, due to the harassment of accused Nos.1 to 4, the deceased committed suicide on 03.01.2026. Based on the said complaint, police registered a case for the aforementioned offences against the accused.

Heard Sri V. Ram Mohan Reddy, learned counsel appearing for the petitioners as well as Sri E. Ganesh, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the allegations and they never resided with accused No.1 and the deceased, being residents of Asifnagar, Hyderabad. He further submitted that accused No.4 is employed in GHMC, and there is no possibility of harassment of the deceased by these petitioners. Therefore,
prayed the Court to grant pre-arrest bail to the petitioners by allowing the Criminal Petition.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that allegations are leveled against these petitioners also in the complaint. However, he informed that in the remand report, it is mentioned that action will be taken against accused Nos.3 and 4 after examination of independent witnesses and collection of evidence. 6.
In light of the submissions made by both learned counsel and upon a perusal of the material available on record, it is observed that there are no specific allegations against these petitioners and that they never abetted the deceased to commit suicide and never harassed her at any point of time. Considering the nature of allegations against these petitioners, custodial interrogation does not appear necessary at this stage. In view of the facts and circumstances of the case, this Court deems it fit to grant prearrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the learned XXV Additional Judicial Magistrate of First Class, at Rajendra Nagar, Ranga Reddy District within two weeks from today, and on such surrender, the petitioners shall be released on bail on executing a personal bond for Rs.25,000/- each with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
