THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7498 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.2 seeking bail in crime No.24 of 2015 on the file of P.S., Rolugunta, Visakhapatnam District, registered for the offence under Sections 20(b) and 25 of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act). Heard and perused.

The allegation against the petitioner/A.2 is that he along with the other accused was found in possession of 280 kgs of ganja. Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is falsely implicated in the case. He prays to grant bail to the petitioner/A.2. Learned Public Prosecutor submits that the petitioner is having bad antecedents and he is having other cases of similar nature, and as such, seeks rejection of bail. Considering the fact that the quantity of ganja seized from the petitioner/A.2 is commercial quantity, and as there is a bar to grant bail in case of commercial quantity and also as the petitioner is having bad antecedents, this Court is not inclined to grant bail to the petitioner/A.2.
