THE HON'BLE SRI JUSTI CE V. RAMASUBRAMANI AN C.R.P.No.1885 of 2017 ORDER:
This revision arises out of an order of attachment passed by the Executing Court. The order of attachment is of the movables in an Ayurvedic medical shop run by the petitioner.
2. Today the petition for condoning the delay in filing the Second Appeal against the money decree has been dismissed. Therefore, the petitioner has no option except to pay the money. However, if the attachment continues, the petitioner may not be able to pay the money. Therefore, this revision is disposed of granting three months time to the petitioner to make payment of the arrears of rent, in three equal monthly installments. The first of the installments of the arrears shall be paid on or before January 7th of 2018. On this condition the order of attachment is lifted. If the petitioner fails to pay the installments, as above mentioned, the order of attachment will automatically stand revived.
3. As sequel, miscellaneous petitions pending in this revision, if any, shall stand closed. There shall be no order as to costs. __________________________ JUSTI CE V. RAMASUBRAMANI AN 8th December, 2017 Js.
