Heard.

The petitioner herein is the grand father of minor boy by name K.Manohar Reddy and since the minor boy was missing, on his request, the learned Judicial Magistrate of First Class, Vinukonda, passed an order in Crl.M.P.No.459 of 2105 on 11-03-2015 directing the 2nd respondent to conduct search on or before 16-03-2015 in the house of the respondents 3 and 4 herein and locate the kidnapped minor boy and produce before the learned Magistrate forthwith. Complaining that no action is taken by the 2nd respondent in spite of the said order, the present writ petition is filed by the petitioner.

Learned Government Pleader has received instructions, which state that the 2nd respondent conducted search on 13-03-2015 but the said kidnapped boy was not traced out and as such could not be produced before the learned Magistrate. However, the learned Government Pleader on the latest instructions submits that the boy has since been traced out on 30-04-2015, the 2nd respondent has requested the learned Magistrate to take up the case to enable him to produce the minor boy before the learned Magistrate. However, no date appears to have been given by the learned Magistrate.

In view of the fact that the minor boy is traced out and the 2nd respondent is prepared to produce him before the learned Magistrate, the writ petition is disposed of requesting the learned Magistrate to take up the matter on 05-05-2015, on which date the 2nd respondent shall produce the minor boy before the learned Magistrate and thereafter, the learned Magistrate would pass appropriate orders. Accordingly, the writ petition is disposed of. No order as to costs.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
