HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.1069 of 2017 ORDER:

Heard before admission and before notice to the 2nd respondent and perused the impugned order. Though it is the contention that the complainant filed memo as if DTDC Courier service is served on the accused, it is not served from filing of the track record in cause issuing NBW at the instance of the complainant against the accused. He should have been chosen to file an application before the lower Court for recall of warrant by showing the same as genuine cause, but however approached this Court by maintaining revision. Having regard to the above and in the result, the Criminal Revision Case is disposed by giving liberty to the petitioner to surrender before the learned Magistrate pursuant to the warrant with an application under Section 44 Cr.P.C. and execute bonds with or without sureties being ordered by the trial Court under Sections 88 & 89 Cr.P.C. on the same day for his release therefrom.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
