ORDER

This petition is filed by the petitioners/A-2 and A-3 under Sections 437 and 439 of the Code of Criminal Procedure, 1973 seeking to grant bail in Crime No.1 of 2016 of Pedabayalu Police Station, Visakhapatnam District, registered for an offence punishable under Section 20(b)(i) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard and perused the material available on record. Case of the prosecution is that on 4.1.2016, the petitioners/A-2 and A-3 along with A-1 were found transporting 644 kgs. of ganja illegally.

Learned counsel for the petitioners submitted that the petitioners are innocent of the offence alleged against them and they have been falsely implicated in the present case. The petitioners are found in possession of 644 kgs. of ganja. Earlier, the bail application filed by A-1 to A-3 was dismissed on 27.4.2016. There is no substantial change of circumstances. Since the ganja found is more than the commercial quantity and considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners.
