THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE MS JUSTICE J.UMA DEVI Writ Petition No.25284 of 2017 ORDER: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) The relief sought for in this writ petition is to issue a writ of certiorari declaring the raid conducted by the 3rd respondent along with the 6th respondent on 17.06.2017 and 19.06.2017 as illegal, arbitrary and in violation of principles of natural justice. When we asked Sri Ranjan Mukharjee, learned counsel appearing on behalf of the petitioners, as to how a writ of certiorari would lie, learned counsel would submit that a writ of mandamus ought to have been sought; and liberty be granted to amend the prayer in the writ petition.

As the very basis on which writ petition is filed is for a writ of certiorari which, admittedly, cannot be sought against the raid conducted by the District medical and Health Officer, we see no reason to entertain the writ petition.

Granting liberty to the petitioners to file a writ petition afresh, this Writ Petition is dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs. _________________________________ (RAMESH RANGANATHAN, ACJ) __________________________ (J.UMA DEVI, J) 10th August, 2017 JSU
