THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.28986 of 2017 ORDER:

Heard Mr S.R.Sanku counsel for the petitioner and the Assistant Government Pleader for Home.

The petitioner prays for the following relief: ".....writ of mandamus declaring the inaction of the respondent No.1 in identifying and arresting the accused in Crime No.136/2017 on the file of the Malkapuram Police Station, Vishakhapatnam, and not proceeding with the investigation by duly recording the statements of the witnesses and collecting evidence lawfully and scientifically to lay an objective charge sheet, by ascertaining the cause of death of deceased by name Peesa Ramana Babu on 20.07.2017 at 11.00 p.m, as illegal ......" The status of investigation so far done is placed before the Court.

Having regard to the information disclosed in the written instructions, for the present, this Court is of the view that the Investigating Officer/Superintendent of Police, Malkapuram Police Station, Vishakhapatnam need not be issued further directions.

The writ petition is disposed of, as no further order is necessary for the present and it is placed on record that the SHO/1st respondent acts as informed to this Court through

written instructions dated 19.09.2017. The investigation is to be expedited, matter enquired into and proceeded in accordance with law. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
