HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.853 of 2020 ORDER:
Heard the learned counsel for the petitioners as well as the learned Standing counsel appearing for the 1st respondent - Municipality.
The basic grievance of the petitioners in the writ petition is that the 1st respondent - Municipality without issuing any notice attempting to demolish their houses.
Learned Standing counsel, on instructions, informs the Court that the 1st respondent - Municipality will issue notice and take appropriate steps as per law.
In the light of the specific submission made by the learned Standing counsel, the writ petition is disposed of, directing the 1st respondent - Municipality not to demolish the houses of the petitioners without resorting to due process of law. Till orders are passed, the 1st respondent is directed not to take any coercive steps against the petitioners in respect of the constructions made by them. No order as to costs.
Miscellaneous petitions, if any, shall also stand disposed of.
