Heard learned counsel for the petitioner.

Learned Standing Counsel for respondent No.2 submits that with regard to the subject matter, a civil suit is pending, as such, the writ petition is not maintainable.

In the light of the above submission, the writ petition is disposed of giving liberty to the petitioner to approach the civil Court by filing an appropriate application in the pending suit.
