HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CIVIL REVISION PETITION No.1900 of 2013 ORDER:

This Civil Revision Petition is filed by the petitioner under Article 227 of Constitution of India, challenging the order, dated 14-03-2013 passed in I.A.No.49 of 2013 in O.S.No.09 of 2011 by the Senior Civil Judge, Parvathipuram, whereby the petition filed under Section 45 of Evidence Act read with 151 of CPC was dismissed.

It is brought to the notice of this Court that O.S.No.09 of 2011 was disposed of by the Senior Civil Judge, Parvathipuram, on 23-08-2013 and appeal against the said decree and judgment is pending in A.S.No.84 of 2013 on the file of Judge, Family Court, Vizianagaram. Therefore, this Court need not examine the legality of the order at this stage after disposal of main O.S. itself. Hence, I find that this Civil Revision Petition has become infructuous.

Accordingly, the Civil Revision Petition is dismissed as infructuous. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
