THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.937 of 2020 ORDER:

This writ petition is filed to declare the action of the second respondent in not conducting investigation in Cr.No.246/2019 as per the provisions of the Code of Criminal Procedure, 1973 as illegal, improper, arbitrary and in violation of Articles 14 and 21 of the Constitution of India. 2.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home for respondents 1 and 2. 3.

Learned Assistant Government Pleader for Home, on written instructions, dated 10.01.2020, a copy of which is placed on record, submits that basing on the Court endorsed complaint of the petitioner, a case was registered in Cr.No.246/2019 under Sections 447 and 448 I.P.C and Section 156 (3) Cr.P.C by the R.G.I Airport Police Station on 22.05.2019. Learned Government Pleader further submits that during the course of investigation, LWs. 1 to 4 were examined and their statements were recorded and notice under Section 91 Cr.P.C was issued to the complainant on 22.05.2019 with a request to produce relevant documents in support of his complaint. Learned Assistant Government Pleader also further submits that the case is under investigation for collection of Will Deed copy from the complainant and after collecting the same, the case will be finalized.

At this stage, learned counsel for the petitioner submits that the petitioner will approach the respondent authorities immediately and furnish necessary documents in support of his complaint.

Having regard to the submissions made by the learned counsel for the petitioner and recording the submissions made by the learned Assistant Government Pleader for Home for respondents on the basis of written instructions, no further orders need be passed in this writ petition. 6.

Accordingly, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
