HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.858 of 2020 ORDER :

Heard learned counsel for the petitioner as well as the learned Assistant Solicitor General appearing for respondent No.1, learned Standing Counsel for National Highways Authority of India appearing for respondent No.2 and the learned Assistant Government Pleader for Land Acquisition appearing for respondent No.3.

The learned Standing Counsel for National Highways Authority of India appearing for respondent No.2 and the learned Assistant Government Pleader for Land Acquisition appearing for respondent No.3 submits that the Award was passed and entire compensation was paid to the petitioner not only in respect of the subject lands, but also in respect of the land in Sy.No.423, situated at Jeellacheruvu Village, Kusumanchi Mandal of Khammam District, and a sum of Rs.17,00,000/- (Rupees seventeen lakhs only) was paid to the petitioner for the land in the said survey number. It is also submitted that even otherwise also, the subject lands are different from the land in the above said Sy.No.423. Since Award was passed on 31.01.2019 and the so-called Papaya Trees located in the subject lands are planted after passing of

ARR,J W.P.No.858 of 2020 the Award dt.31.01.2019, no relief can be granted in this writ petition.

The Award is passed and entire amount is paid and petitioner knowing fully well planted the trees after Award is passed.

Therefore, I do not see any reason to entertain the writ petition and it is accordingly dismissed. It is needless to say that if the compensation amount is not already paid to the petitioner, the respondents are directed to pay the same at an early date. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
