Heard learned counsel for the petitioners, Government Pleader for Municipal Administration and Urban Development, and Government Pleader for Revenue.

The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of the respondents in trying to demolish the petitioners' respective houses and shops on the ground of alleged encroachments for the purpose of widening of road without following the procedure and unilaterally trying to widen the road by dispossessing the petitioners 1 to 5 from their respective houses D.No.17/99, D.No.18/71, D.No.17.218, D.No.17/95, D.No.17/94 of petitioner Nos.1 to 5 situated at Tilak Road Anantapur and petitioner No.5 from D.No.17/96, Neeruganti Street, Ananthapur, as illegal, arbitrary and violatives of principles of natural justice; and consequently to direct the respondents not to demolish the petitioners' houses and shops on the ground of alleged encroachment.

Though various grounds are raised learned counsel for the petitioners restricts his prayer seeking a

direction to the respondents to follow due process of law. Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents not to interfere with the subject properties in the context of road widening except in accordance with the due procedure laid down by law. No order as to costs.
