Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The present Criminal Petition came to be filed by the petitioner/A.1 under Section 438 Cr.P.C., seeking release in the event of his arrest in Crime No.164 of 2016 of Women Police Station, Saroornagar, Ranga Reddy District, registered against him and others for the offences punishable under Sections 498A and 406 IPC and 3 and 4 of the Dowry Prohibition Act, 1961.

The case of the prosecution is that marriage of the informant Smt. Mahmooda Begum was performed with petitioner/A.1 on 07.05.2015. Some days after the marriage, she went to Dubai along with him and returned to India unable to bear harassment by him. It is stated that after return to India, A.2 and A.3 abused her in filthy language, retained all jewellery on her person besides costly articles in her possession, and drove her out of the matrimonial home demanding to get additional dowry of Rs.5.00 lakhs. It is stated that at the instigation of other accused, petitioner/A.1 was harassing her physically and mentally for want of additional dowry. Basing on these allegations, the present case came to be registered. 4.

Learned counsel for the petitioner submits that the allegations in the report are false. He placed on record copy of representation given by the petitioner to the Faisla Committee, Karimnagar District seeking to settle the issue. That by itself may not be a ground to grant anticipatory bail to the petitioner, as the same is pressed into service after registration of the crime. However, having regard to the circumstances of the case, the petitioner is at liberty to surrender

before the Court concerned within a period of 10 days from today and move an application for grant of regular bail after giving prior notice to the Public Prosecutor concerned, in which event, the Court concerned shall consider the bail on the same day on such terms and conditions as it deems fit and proper.
