THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY WRIT PETITION No.1362 of 2022 ORDER:

Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Sri M. Ram Gopal Rao, learned Standing Counsel, for the respondents. With their consent, the Writ Petition is disposed of at the admission stage. Seeking to declare the action of the respondents in trying to lay road through the land of the petitioner admeasuring Acs.2-00 guntas situated in survey No.42/AA of Alinagar Village, Gaddapotharam Gram Panchayat, Jinnaram Mandal, Sanga Reddy, without acquiring the same or without following due process of law, as illegal and arbitrary, the present Writ Petition is filed.

The learned Standing Counsel, on instructions, has stated that the total area of survey No.42 is admeasuring Acs.176.21 guntas, out of which, an area of Acs.5-00 has been allotted for the purpose of 'Palle Prakruthi Vanam' whereas the land of the mother of the petitioner is in survey No.42/AA admeasuring Acs.2-00 and that the official respondents are not interfering with the land claimed by the petitioner.

In view of the submissions made by the learned Standing Counsel, the grievance of the petitioner stands redressed. However, it is made clear that in case the official respondents want to utilise the land of the mother of the petitioner, they can do so strictly in accordance with law.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________ A.ABHISHEK REDDY, J Date : 15.02.2022.
